We act for a Seller or Buyer of residential property which may be vacant land, a house or a home unit. It is important that the agreement protects the interests of the parties.
For example a Buyer should insist on the inclusion of a due diligence special condition in the agreement making the sale conditional upon the Buyer obtaining satisfactory results of searches and enquiries in relation to the property being purchased.
The Buyer should obtain taxation advice from a qualified accountant on the best structure for the deal.
We provide advice to a Buyer about “off the plan” transactions. If the land has not been subdivided or a home unit has not yet been built at the time of entering into the contract this is commonly known as an “off the plan” sale which means that the plan has not yet registered. “Off the plan” contracts for each sale of this type of property are prepared specifically for the development being undertaken. These contracts are complex.
